Clearial Terms of Use
1. Eligibility
Clearial is intended for adults who have reached the legal drinking age in their jurisdiction. By using the app, you confirm that you meet this requirement.
2. Not Medical Advice
Clearial is a self-tracking and habit-awareness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. If you are concerned about your relationship with alcohol, or believe you may be experiencing withdrawal or dependence, please consult a licensed healthcare professional. If you are in crisis, contact your local emergency services.
3. Subscriptions & Auto-Renewal
Clearial offers the following plans, billed through your Apple App Store account:
- Weekly Premium — auto-renewing, with an optional free trial
- Monthly Premium — auto-renewing, with an optional free trial
- Yearly Premium — auto-renewing, with an optional free trial
- Lifetime Premium — one-time purchase, no renewal
Current prices, billing periods and free-trial lengths for your country are always shown on the purchase screen inside the app and on the App Store product page before you buy. Those figures take precedence over any example shown elsewhere.
Auto-renewal
- Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
- If a free trial is offered, your payment method will be charged when the trial ends unless you cancel before it does.
- Your iTunes account will be charged for renewal within 24 hours of the end of the current period.
- You can manage your subscription and turn off auto-renewal in your device's App Store account settings.
Refunds
- Refund requests must be made directly through Apple at reportaproblem.apple.com. We cannot issue refunds on Apple's behalf.
- No refund is provided for the unused portion of a subscription term or the Lifetime purchase.
Price changes
- We may change subscription prices. Any price change will be communicated to you in advance and will only apply to future billing periods. Continued use after a price change constitutes acceptance.
4. License to Use the App
Subject to your compliance with these Terms, Bulsu Labs grants you a limited, non-exclusive, non-transferable, revocable license to use Clearial for your personal, non-commercial use on Apple devices you own or control.
5. User Content
Notes and entries you add to your drink log stay on your device. You are responsible for the content you enter and for keeping your device secure.
6. Intellectual Property
Clearial's name, logo, mascot artwork, and in-app content are the property of Bulsu Labs and are protected by copyright and trademark law. You may not copy, modify, or redistribute them without permission.
7. Third-Party Services
Clearial uses Apple's StoreKit, RevenueCat, Apple Health, and Sign in with Apple as described in our Privacy Policy. Your use of those services is also governed by their own terms.
8. Disclaimers
Clearial is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the app will be uninterrupted, error-free, or that it will help you achieve any particular outcome.
9. Limitation of Liability
To the maximum extent permitted by law, Bulsu Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Clearial.
10. Termination
You may stop using Clearial and delete the app at any time. We may suspend or terminate access for violations of these Terms.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the revised Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Montenegro, without regard to conflict-of-law principles, except where mandatory local consumer-protection law requires otherwise.
13. Apple App Store Additional Terms
This App is licensed, not sold, to you for use only under the terms of this license. You and Apple acknowledge that:
- These Terms are between you and Bulsu Labs, not Apple.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Apple has no other warranty obligation.
- Bulsu Labs is responsible for product claims, legal and regulatory requirements, and intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
